Calling all Detroit Rappers, Poets,

Comedians, and Vloggers!

 

We want you to weigh in on the conversation about Detroit’s future and we’re offering a cash prize of $500 and two runner up prizes of $250. We’re hearing conversations about the two Detroits, and the poverty, crime, violence alongside conversations about resurgence and Detroits recovering economy.

 

We want you to weigh in, and tell us what you think the city leadership should be doing to deal with these issues. And we want to laugh, cry or bob our heads along the way. We want to know what positions you think Detroits next mayor and city council members should be taking. We want to know if your family and friends are taking part in Detroits economic resurgence. We want to know if you’ve been dealing with the fallout from Detroit’s high rates of gun violence, economically generated crime and whether or not you’ve received support in this time of abundance in Detroit.      

 

Besides Detroit’s downtown, midtown and aside from the few rebounding neighborhoods, according to data Detroiters are dealing with very high levels of poverty, gun violence remains a huge issue, and our local economically driven crime is feeding our state prisons. According to Detroit Future Cities 129 Square Mile report we know that: 

  • 57% of Detroits children live in poverty; 40 percent of the city lives in poverty.

  • Only 33% of the jobs in Detroit are held by African Americans. Since Detroit is 80% African American, its fair to use race as a measure for residency. The vast amount of African Americans employed in Detroit work in companies outside of Detroit in positions that pay less than 15K.

We’ve also heard that Detroit hustles harder. Unfortunately, in a city that is highly poor, that means lots of economically generated crime.

  • Despite steady population decline (a decline most notable outside of the downtown, midtown and the few other rebounding neighborhoods), in 2016, according to the city of Detroit website, there were 31,850 property crimes and 3060 robberies.

And we think that there is a connection between the mentality of “hard hustling,” the well known no snitching rule, poverty, and violence. Here are some of the FBIs most recent findings on violence in Detroit:

  • According to the FBI’s 2016 Uniform Crime report,  13,705 violent crimes — including murders, rapes, assaults and robberies — were reported in Detroit last year.  That’s a 15.7% increase from the year before, which saw 11,346 violent crimes in Detroit.

  • Skill – the degree to which you are presenting mastery of your craft; be that comedy, lyricism, or just your own personality.

Promotion Calendar and Timing: The Pico Network® “The $500 Holla” Contest (the “Contest”) begins at 12:00:00 AM Eastern Time (“ET”) on October 26, 2017, and ends at 11:59:59 PM ET on November 9, 2017 (the “Promotion Period”).  For purposes of this Contest, a “day” is defined as a 24-hour period, beginning at 12:00:00 AM ET and ending at 11:59:59 PM ET.  The Sponsor’s computer, or that of its designee, runs the official clock for the Contest and will solely determine the time by which an entry is received.  

 

During the Contest there are a series of events (explained in detail in the Chart below), which start and end on or about the dates and times noted below.

Eligibility: Contest is open to all long term Detroiters (of 8 years or more) (you must be able to prove residency) who are at least eighteen (18) years of age or older at the time of entry with a valid U.S. taxpayer identification number (“Entrant”). Employees and consultants of Pico Network (“Sponsor”), and its parent company, related subsidiaries and affiliated companies, and advertising and promotion agencies including Marden-Kane, Inc. (“Administrator”), and each of their immediate family members (spouse, parents, children, siblings, and their respective spouses regardless of where they live) and individuals living in the same households of the above, whether or not related, are not eligible to enter or win a prize.  Each Entrant, by participating in the Contest, agrees to be bound by these Official Rules and the Sponsor’s decisions.  Void where prohibited or restricted by law. The Contest is subject to all applicable federal, state, and local laws and regulations.

 

How To Enter: To enter the Contest, you’ll first need to become a registered user of www.Instagram.com (“Instagram”) or log into your Instagram account.  Once you become a user and log in, your account must be set to “public”.  If you do not have an account, go to www.Instagram.com to create one. Instagram accounts are free. By submitting your information and creating an Instagram account, you agree to the Instagram terms of use and privacy notice. If you do not agree to such terms of use and privacy notice, you cannot create an Instagram account or participate in this Contest.  You can return your account to “private” any time after the winner announcement.

 

To Enter:

  1. Your Instagram privacy options on your account settings must be set to “OFF”.
  2. Create a video of no more than 60 seconds and tell us your thoughts (as per the Contest Description section above) on:

  2. Optional: Geotag your post.
  3. Video Guidelines:  Your video must comply with Instagram community guidelines and must be no more than the maximum length allowed by Instagram (60 seconds).
  4. Post must be sent from one (1) Instagram account only. Multiple accounts may not be used and anyone found to use multiple accounts to enter will be ineligible.
  5. Branded filters, stickers, emojis and words of any kind on the Video are not allowed.
  6. Only one Video is allowed per entry. Use of any branded application to create a video slideshow is not allowed.

 

Limit one (1) Entry per person/per day; however each Entry must be substantially different than any other Entry submitted by you.  Regramming or copying and using a video created by another user is not allowed. Entries received in excess of the entry limit stated herein will be disqualified.

 

Multiple Entrants are not permitted to share the same Instagram account. Any attempt by any Entrant to submit more than the stated number of Entries by using multiple/different Instagram accounts, identities, or any other method will void that Entrant’s Entry(ies) and that entrant may be disqualified.  Entries that do not comply with these Official Rules, as determined in Sponsor’s sole discretion, will be disqualified from the Contest. If the Sponsor determines that the content of the Entry is obscene, offensive, or inappropriate or otherwise not in keeping with Sponsor’s image or these Official Rules (including, but not limited to, the Entry Contest Guidelines below), the Entry will not be eligible for any prize consideration and may be withdrawn from the Contest at any time at the sole discretion of the Sponsor.

 

By uploading your Video, you agree that (1) your Video conforms to the Terms of Use/Guidelines and Content Restrictions of Instagram; (2) your Video conforms to the Guidelines and Content Restrictions below; and (3) Sponsor and/or Administrator, in its sole discretion, and without notice, may remove your Video from the Contest and disqualify you from the Promotion if it determines that your Video fails to conform to the Guidelines and Content Restrictions or otherwise with the terms of these Official Rules.   

 

Entry Content Guidelines:

  • Entry must be in English.
  • Incomplete or inaccurate Entries are void. By entering, Entrants acknowledge compliance with these Official Rules, including all eligibility requirements.
  • Entry must be Entrant’s own original creation executed solely by Entrant, may not have won any previous award or been submitted in any other competition, and must be a previously unpublished and previously un-produced work.
  • Entry must be in keeping with Sponsor’s image and may not be obscene, indecent or otherwise offensive, as determined by judges or Sponsor at their sole discretion, nor can the Entry defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights, including but not limited to intellectual property rights, and the right to submit or use same shall not be restricted.
  • Entry must not feature brand names, logos or trademarks unless owned by the Entrant, nor can they promote or endorse an canidate;
  • Content cannot promote any activities that may appear unsafe or dangerous.
  • Content cannot endorse any form of hate or hate group.
  • Content cannot defame, misrepresent or contain disparaging remarks about any person or entity, including but not limited to the Sponsor or its affiliates or their products or services, as determined in the sole discretion of the Sponsor.
  • Content cannot contain any material that may, in the sole judgment of Sponsor, infringe on the intellectual property rights of any third party, including but not limited to, copyrights or trademarks owned by others.
  • Content cannot advertise or promote any third party brand or product of any kind or contain any personal identification, including, but not limited to: license plate numbers, personal names, e-mail addresses, phone numbers, or street addresses.
  • Content cannot contain materials embodying the names or other indicia of, or identifying any person, living or dead (other than yourself), unless appropriate permission and releases have been obtained for your use of such material in your Entry.
  • Content cannot communicate messages inconsistent with the messages, policies, and/or goodwill with which the Sponsor wishes to associate, as determined in the sole discretion of the Sponsor.
  • Content cannot be in violation of any applicable federal, state, and/or local laws, rules, and regulations.

 

If the Sponsor determines in its sole discretion that the content of the Entry is obscene, offensive, inappropriate, or unacceptable for any reason, the Entry will not be eligible for any prize consideration and may be withdrawn without notice from the Contest at any time at the sole discretion of the Sponsor and/or Administrator.  By submitting an Entry and using the hashtag(s), Entrant acknowledges that he/she read, understands and agrees to the Official Rules. Entries may only be submitted by a single Entrant.  Entries that do not comply with these Official Rules, as determined in Sponsor and/or Administrator’s sole discretion, will be disqualified from the Contest.

 

The person submitting the Entry must be the authorized account holder of such Instagram account, otherwise the Entry may be deemed void. In the event of a dispute over the identity of a potential winner, the Entry will be declared made by the authorized holder of the Instagram account used for entry, and potential winner may be required to provide identification sufficient to show that he/she is the authorized account holder of such Instagram account. It is the sole responsibility of the Entrant to notify the Sponsor in writing if the Entrant changes his or her Instagram account during the Promotion Period. Proof of submission of entry does not constitute proof of delivery of entry. All Entries become the property of Sponsor.

 

Judging:    

At the conclusion of the Entry Period, a panel of judges consisting of the Sponsor and its representatives (the “panel”) will score each eligible Entry based on the following Judging Criteria (the “Judging Criteria”):

 

  • Content – your ability to present factual information in a way that is creative, fun and entertaining (50%); and
  • Skill – the degree to which you are presenting mastery of your craft; be that comedy, lyricism, or just your own personality (50%).

 

The potential one (1) Grand Prize winner will be the Entrants who submitted the Entries that received the highest scores, as determined by the panel in its sole discretion.  The potential two (2) Runner-Up winners will be the Entrants who submitted the Entries that received the next highest scores after the potential Grand Prize winner, as determined by the panel in its sole discretion.  In the event of a tie, from among those tied, the winner will be the Entry receiving the highest score in the Content category.  In the event of a tie in Content judging criteria, the Entries will be re-judged by a different panel of judges.  Judging scores will not be revealed.  The decisions of the panel are final.

 

Winner Notifications and Verification: The Sponsor will contact potential winners on or about November 15, 2017 as stated in the Contest Timing Chart above.  Notification will occur by an Instagram Direct Message (“DM”) or an Instagram Notification by adding a comment from @Pico Network to each potential winner’s Entry submission on each potential winner’s Instagram account.  The potential winners will be required to respond to the direction in the message within twenty-four (24) hours with full contact information, including email address and phone number.  Potential winners will be required to complete and sign an Affidavit of Eligibility and Liability Release and Declaration of Compliance; and where legal, a Publicity Release (collectively the “Affidavit”).  Complete forms must be returned within three (3) days of notification date or the prize will be forfeited and a runner-up will be notified.  In the event that any potential winner cannot be contacted, or the failure to timely return any documents requested, return of prize or prize notification as undeliverable, or noncompliance with these Official Rules, or if the potential winner declines the prize for any reason, such potential winner will be disqualified and the prize will be forfeited. Sponsor shall have no further obligation to a potential winner who is disqualified and a runner-up may be notified, at Sponsor’s discretion, time permitting.  Except where prohibited, acceptance of a prize constitutes winner’s consent to use of his/her name and/or photograph without further compensation for advertising, promotional and publicity purposes by Sponsor.  By accepting a prize, winner(s) acknowledge(s) compliance with these official rules.  Sponsor is not responsible for any change of email address, mailing address and/or telephone number of entrants.  

 

Prizes: One (1) Grand Prize Winners: $500 cash (awarded in the form of a check made payable to the winner). Retail Value (“RV”): $500.00.  Two (2) Runner-Up Winners: $250 cash (awarded in the form of a check made payable to the winner). RV: $250.00 each.  Total RV of all prizes: $1,000.00.  No equivalents, transfers or substitution of a prize permitted except at the sole discretion of the Sponsor, who reserves the right to substitute a prize (or portion thereof) of comparable or greater value, at its sole discretion. Winners are responsible for the payment of all taxes on the prize.  All prize details are at Sponsor’s sole discretion.  Prize is provided “as is” and without any warranty of any kind.  Prize is non-transferable.  Limit one (1) prize per person.

 

Publicity: Except where prohibited, participation in the Contest constitutes each winner’s consent to Sponsor’s and its designees’ use of such winner’s name, Entry Submission, Instagram user name, likeness, photograph (including, without limitation, Instagram profile photo), opinions, hometown and state for advertising, promotional and other purposes, in any manner, in any and all media, now or hereafter devised, worldwide in perpetuity, without further payment or consideration, notification or permission.

 

Ownership of Entry & Grant of Rights: By entering the Contest, and to the extent allowed by law, Entrants grant the Sponsor, and its affiliates, licensees, promotional partners, developers, and third party marketing entities (collectively, “Licensed Parties”) a non-exclusive, perpetual, sublicensable, royalty-free license to edit, modify, cut, rearrange, add to, delete from, copy, reproduce, translate, dub, adapt, publish, broadcast, perform, exploit, use, and reuse (without limitation as to when or to the number of times used) the Entries themselves and the content of, and elements embodied in the Entries, including any names, social media handles, locations, and likenesses, in any and all media, including but not limited to digital and electronic media, computer, audio, and audiovisual media (whether now existing or hereafter devised), throughout the world, in perpetuity, and in any manner, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation to Entrant or any third party. To the extent permitted by law, each Entrant waives and releases the Licensed Parties, from and agrees to not exercise against the Licensed Parties, any and all claims that each Entrant may now or hereafter have in any jurisdiction based on “moral rights” or “droit moral” or unfair contest with respect to the Licensed Parties’ exploitation of Entries without further notification or compensation to Entrants of any kind. Each Entrant unconditionally and irrevocably consents to any act or omission by the Licensed Parties that would otherwise infringe his/her moral rights and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given, and agrees not, unless there has been any use of an Entry or any derivative works thereof in a manner contrary to these Official Rules, to instigate, support, maintain, or authorize any action, claim, or lawsuit against the Licensed Parties or any other person in connection with this Contest, on the grounds that any use of any Entry or any derivative works thereof, infringe or violate any rights of any Entrant and/or any participant therein. For the avoidance of doubt, the Entrants agree to the publication of their Entries.

 

Conditions of Entry:  Sponsor, Instagram, LLC, and their respective parent companies, related subsidiaries and affiliated companies, prize suppliers, and advertising and promotion agencies including Administrator, and all of their respective officers, directors, shareholders, employees, representatives and agents (collectively, “Releasees”) are not responsible for: (i) incorrect or inaccurate transcription of entry information, or for any human, typographical or printing errors, (ii) technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, wireless service, inability to access any online service or website, inability to submit the online enrollment form, or any other error or malfunction, or any injury or damage to Entrant’s or any other person’s computer and/or wireless device related to or resulting from participation or downloading any materials in this Contest, (iii) or for late, lost, stolen, illegible, damaged, incomplete, inaccurate, undelivered, delayed or misdirected entries, posts, Photos, Videos or direct messages, for any reason including computer, telephone, wireless service, paper transfer, or process any transaction thereon, (iv) other errors or problems which may occur in connection with the administration of the Contest, the processing of entries, the announcement of the prizes or in any Contest related materials.  Entry materials that have been tampered with or altered are void.  If, in the Administrator’s opinion there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of this Contest, or if technical difficulties compromise the integrity of this Contest, the Administrator reserves the right to disqualify any individual (and void his/her entry and/or prevent him/her from future entry), and/or who tampers with the entry process and/or who is acting in violation of these Official Rules, to modify or cancel or terminate this Contest, in whole or in part, at any time without notice.  Caution: Any attempt to deliberately damage any online service or website associated with this Contest or undermine the legitimate operation of this Contest may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages (including attorneys’ fees) and/or other remedies from any such person to the fullest extent permitted by law.  Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision.  Sponsor reserves the right to modify prize award procedures at their discretion.

 

Disputes and Limitation of Liability:  By participating in the Contest, except where prohibited, Entrants agree: [1] to release, indemnify and hold harmless Releasees from and against any injuries, losses, damages, claims, actions and any liability of any kind resulting from or arising from participation in the Contest or acceptance, possession, use, misuse or nonuse of the prize (including any travel or travel-related activity thereto) that may be awarded; [2] any and all disputed, claims and causes of action arising out of or connected with this Contest or any Contest prize awarded shall be resolved individually, without resort to any form of class action, and exclusively within the State of Michigan; [3] any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, and in no event will Entrants be permitted to obtain attorneys’ fees or other legal costs; and [4] under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. This Contest and these Official Rules shall be interpreted in accordance with the laws of the State of Michigan without regard to its principles of conflicts of law.

 

Privacy:  Personal information collected from Entrants is used only for the purpose of the Contest and to notify winners, and will not be re-used, sold or shared in any manner by Sponsor or any third parties unless Entrant has opted-in to receive additional information and marketing or promotional material from Sponsor or a third party.
